Prenuptial agreements are enforceable in Greece but remain relatively uncommon due to the country’s default regime of separation of assets. Under Article 1400 of the Greek Civil Code, a spouse who contributes to the increase in the other spouse’s assets may claim a share of that increase.
Spouses may opt into a community-property regime if they choose, and a premarital agreement can formalize this selection. All agreements must comply with Greek statutory requirements and must not violate public order or mandatory protections afforded to spouses.
