By Elena Giannattasio, International Family Lawyer (New York & San Francisco), Multi-Jurisdictional Divorce, PLLC
Prenuptial agreements are fully enforceable in Finland, and spouses may also elect in advance which jurisdiction’s law will govern their marriage, provided at least one spouse has a nationality or domicile connection with the chosen country.
Formal requirements are strict:
● The agreement must be in writing,
● Dated and signed by both parties,
● Witnessed by two disinterested individuals, and
● Submitted to the Local Register Office (Maistraatti).
The prenup does not become valid until formally registered. These procedural steps are essential for enforceability, particularly where international mobility is expected.
Our Global Practice Perspective
From her New York and San Francisco offices, international family lawyer Elena Giannattasio would coordinate with Finnish counsel to align prenups with these formalities while preserving U.S. enforceability.
