Prenuptial Agreements in New Zealand

New Zealand recognizes prenuptial agreements, known as “contracting-out agreements” under the Property (Relationships) Act 1976. Agreements must be written, signed, and certified by independent legal counsel for each spouse. They may be set aside only if enforcing them would cause “serious injustice.”
