By Elena Giannattasio, International Family Lawyer (New York & San Francisco), Multi-Jurisdictional Divorce, PLLC
Taiwan recognizes prenuptial agreements under Article 1004 of the Civil Code, allowing spouses to adopt one of the statutory marital property regimes by contract. Agreements may be executed before or after marriage and serve as binding arrangements between spouses.
Our Global Practice Perspective
For couples with Taiwanese connections or assets, such agreements play an important role in establishing property boundaries and avoiding default community-property outcomes across borders.
From New York and San Francisco, international family lawyer Elena Giannattasio advises clients with cross-border family law matters involving Taiwan providing advanced forum analysis and strategic coordination with trusted local counsel in Taiwanese law and other relevant jurisdictions, as appropriate.
